TERMS OF SERVICE — BESTIALE BEAUTY

OVERVIEW
Welcome to Bestiale Beauty.
The terms “Bestiale Beauty”, “Bestiale”, “we”, “us” and “our” refer to Bestiale Makeup SRL, a Belgian company operating the Bestiale Beauty online store.
Our website, online store and related content, features, products and services are collectively referred to as the “Services”.
Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services.
These Terms of Service (“Terms”) govern your access to and use of our Services and purchases made through our online store.
By accessing or using our Services, you agree to be bound by these Terms and by the policies referenced herein, including our Privacy Policy and Returns & Refund Policy.
Nothing in these Terms is intended to exclude, restrict or waive any mandatory consumer right that cannot legally be excluded under applicable law.

2. ELIGIBILITY AND ACCOUNTS
By using our Services, you represent that you have reached the age required to enter into a contract under the law applicable to you or that you are otherwise legally authorised to use the Services.
When creating an account or placing an order, you may be required to provide information including your name, email address, billing information, delivery address and payment information.
You agree to provide accurate, current and complete information.
You are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account, to the extent permitted by applicable law.
Accounts may not be sold, transferred or assigned to another person without our prior written consent.
3. PRODUCTS
We make reasonable efforts to display and describe our products as accurately as possible.
However, colours and other visual characteristics may appear differently depending on your device, screen settings, lighting and other technical factors.
Product photographs and visual representations are therefore provided for illustrative purposes and may not perfectly reproduce the appearance of the physical product.
We may update product descriptions, packaging, availability and product ranges where reasonably necessary.
Any such changes are without prejudice to orders already concluded and to your mandatory consumer rights.
We reserve the right, where permitted by applicable law, to limit quantities, discontinue products or restrict sales in certain countries or territories.
4. ORDERS AND CONTRACT FORMATION
By submitting an order, you make an offer to purchase the products in your cart.
Receipt of an automated order acknowledgement does not necessarily constitute final acceptance of your order.
A contract is formed when we expressly accept your order or dispatch the ordered products, depending on the checkout and order-confirmation process applicable to your purchase.
We reserve the right to refuse or cancel an order on legitimate grounds, including suspected fraud, payment failure, obvious pricing errors, stock unavailability, restrictions on shipping certain products or suspected unauthorised resale.
If we cancel an order after payment has been received, the corresponding amount will be refunded in accordance with applicable law.

Your rights to cancel or withdraw from a purchase are described in our Returns & Refund Policy and remain subject to all mandatory rights available under applicable consumer law.
5. PRICES, TAXES AND PAYMENT
Prices displayed on our website may vary depending on your delivery country, currency, applicable taxes and the Shopify Market through which you access the store.
For consumers located in the European Union, prices will be displayed in accordance with applicable consumer and tax legislation, including applicable VAT where required.
For orders delivered outside the European Union, including the United States, additional taxes, import duties, customs charges or other governmental charges may apply depending on the destination and the shipping arrangement indicated at checkout.
Where such charges are not expressly included in the price or shipping option displayed at checkout, they may be payable by the recipient to the relevant authority or carrier.
Any applicable charges will be presented or disclosed as required by law.
Prices, promotions and discounts may change from time to time. Such changes do not affect orders for which a binding contract has already been concluded.
You agree to provide accurate and complete payment information and represent that you are authorised to use the payment method selected for your purchase.
6. PROMOTIONS AND DISCOUNT CODES
From time to time, Bestiale Beauty may offer promotions, discount codes, gifts, special offers or other commercial incentives.
Specific conditions may apply to these offers, including validity periods, minimum purchase amounts, eligible products or geographic restrictions.
Unless otherwise stated, promotions cannot be combined.
Nothing in promotional terms affects mandatory consumer rights.
7. SHIPPING AND DELIVERY
Available shipping methods, estimated delivery times and applicable shipping charges are displayed during checkout or in our Shipping Policy.
We will make reasonable efforts to deliver your order within the timeframe communicated to you.
For consumers in the European Union, where no different delivery period has been agreed, goods will be delivered in accordance with the statutory time limits applicable to consumer sales.
If delivery cannot take place within the agreed or legally applicable timeframe, you retain all rights available under applicable consumer law.
For orders delivered to the United States, Bestiale Beauty will comply with applicable U.S. requirements regarding advertised shipping times and delays.
Delivery estimates may be affected by circumstances beyond our reasonable control, including customs procedures, carrier disruption, severe weather or other exceptional events.
Nothing in this section excludes rights you may have under mandatory law in the event of delayed or failed delivery.
8. TRANSFER OF RISK
For consumers in the European Union, where Bestiale Beauty arranges shipment, the risk of loss or damage generally remains with Bestiale Beauty until you, or a third party designated by you other than the carrier, acquire physical possession of the goods.
Where you independently commission a carrier that was not offered by Bestiale Beauty, different statutory rules may apply.
For customers outside the European Union, transfer of risk will be determined in accordance with applicable law and the relevant shipping terms.
Nothing in these Terms limits mandatory consumer protections relating to lost, damaged or undelivered goods.
9. RETURNS, WITHDRAWAL AND REFUNDS
Returns, refunds and, where applicable, the European statutory right of withdrawal are governed by our Returns & Refund Policy.
European Union consumers generally benefit from a statutory 14-day right of withdrawal for distance purchases, subject to applicable exceptions.
Different return rules apply to orders delivered to the United States, as explained in our Returns & Refund Policy.
Nothing in our voluntary return policy limits any mandatory statutory rights.
10. LEGAL GUARANTEE AND PRODUCT CONFORMITY
Consumers benefit from the statutory guarantees and remedies provided by applicable law.
For consumers covered by Belgian and European consumer protection legislation, products must conform to the sales contract and applicable statutory conformity requirements.
Belgian consumers benefit from the applicable statutory guarantee of conformity for consumer goods.
These statutory rights are separate from any voluntary commercial return policy.
Nothing in these Terms excludes or limits any statutory guarantee that cannot legally be excluded.
11. INTELLECTUAL PROPERTY
Unless otherwise stated, the Bestiale Beauty website and its content, including trademarks, trade names, logos, product names, photographs, graphics, text, videos, designs and other original content, are owned by or licensed to Bestiale Makeup SRL and are protected by applicable intellectual property laws.
You may access and use the website for personal, non-commercial purposes.
You may not reproduce, modify, distribute, commercially exploit, republish or create derivative works from protected Bestiale content without prior written authorisation, except where permitted by applicable law.
“Bestiale”, Bestiale logos, product names and associated brand elements may be protected trademarks or other intellectual property of Bestiale Makeup SRL or their respective owners.
Shopify trademarks and intellectual property belong to Shopify or its licensors.
12. THIRD-PARTY TOOLS AND SERVICES
Our Services may include tools, applications, payment services, integrations or other functionality provided by third parties.
Such services may be governed by separate terms and privacy policies.
Where a third-party service is provided independently from Bestiale Beauty, we are not responsible for that third party's acts or omissions except where applicable law provides otherwise.

Our website may contain links to third-party websites.
Bestiale Beauty does not control those websites and is not responsible for their content, availability or practices.
Accessing a third-party website is subject to that website's own terms and policies.
Nothing in this provision excludes liability where Bestiale Beauty is legally responsible under applicable law.
14. SHOPIFY
Our online store is powered by Shopify.
Shopify provides the technology used to operate the store but, unless expressly stated otherwise, purchases of Bestiale Beauty products are made between you and Bestiale Makeup SRL.
Shopify is not the seller of Bestiale Beauty products.
Your use of certain Shopify-provided features may also be subject to Shopify's applicable terms and privacy practices.
15. PRIVACY AND PERSONAL DATA
Personal data collected through our Services is processed in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (“GDPR”) where applicable.
Certain service providers, including Shopify and payment or logistics providers, may process personal data in connection with the operation of our store.

This licence does not transfer ownership of your content to Bestiale Beauty.
Where disclosure of compensation, gifts or other incentives is required in connection with reviews or endorsements, such disclosure must be made in accordance with applicable law.
We reserve the right to moderate or remove unlawful, fraudulent, abusive or otherwise prohibited content, subject to applicable law.
17. ERRORS AND OBVIOUS MISTAKES
Despite our efforts, our website may occasionally contain typographical errors, incorrect product information, availability errors or obvious pricing mistakes.
We may correct such errors when discovered.
Where an error affects an order that has already been placed, we will act in accordance with applicable contract and consumer protection law.
Nothing in this section gives Bestiale Beauty an unrestricted right to unilaterally alter a binding consumer contract.

To the extent permitted by applicable law, we do not guarantee that the website itself will always be uninterrupted, error-free or continuously available.
Any limitations relating to the technical operation of the website are separate from and do not affect statutory rights relating to products purchased from Bestiale Beauty.
21. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing is intended to exclude or limit liability for fraud, wilful misconduct, death or personal injury where liability cannot legally be excluded, or any mandatory consumer right.
To the maximum extent permitted by applicable law, Bestiale Beauty will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the contract was concluded.
For consumers, any limitation of liability contained in these Terms applies only to the extent permitted by the mandatory law applicable to the consumer.
22. INDEMNIFICATION
Where permitted by applicable law, you may be responsible for losses or claims arising directly from your unlawful use of the Services or your intentional violation of these Terms or third-party rights.
Nothing in this section imposes obligations on consumers that would be unfair, disproportionate or unenforceable under applicable consumer protection law.
23. SEVERABILITY
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary under applicable law.
The remaining provisions will continue to apply where legally possible.
24. NO WAIVER
A failure or delay by Bestiale Beauty in exercising a right does not automatically constitute a waiver of that right.
Any waiver will apply only to the extent permitted by applicable law.
25. ASSIGNMENT
You may not transfer contractual rights or obligations where doing so would materially affect Bestiale Beauty without our prior consent, except where applicable law gives you the right to do so.
Bestiale Beauty may transfer its rights or obligations in connection with a restructuring, sale or transfer of its business, provided that such transfer does not reduce mandatory consumer protections or materially prejudice your contractual rights.
26. GOVERNING LAW AND JURISDICTION
These Terms are governed by Belgian law, subject to any mandatory consumer protection rules that apply to you.
If you are a consumer residing in the European Union, this choice of Belgian law does not deprive you of mandatory protections granted by the law that would otherwise apply to you.
Nothing in these Terms requires a consumer to bring proceedings exclusively before the courts of Liège where mandatory jurisdiction rules give the consumer the right to bring or defend proceedings before another competent court.
For customers located in the United States, mandatory rights and jurisdictional rules arising under applicable U.S. federal or state law remain unaffected.
27. CHANGES TO THESE TERMS
We may update these Terms from time to time, for example to reflect changes in our Services, applicable law or business operations.
The version applicable to your purchase is generally the version in effect when the relevant contract is concluded.
Material changes affecting ongoing Services will be communicated where required by law.
Changes to these Terms will not retroactively remove rights already acquired under a concluded consumer contract.
28. ENTIRE AGREEMENT
These Terms, together with the policies expressly incorporated into them, constitute the agreement governing your use of the Services and purchases from Bestiale Beauty, subject at all times to applicable mandatory law.
Nothing in this provision limits rights arising from mandatory consumer legislation.
